Article 1 – General provisions

These general conditions of sale (GCV) govern the contractual relationships between the company LE SHOP GUITARE LYON, SARL with a capital of 23,000 €, whose registered office is located at 28 Quai Arloing 69009 Lyon, registered with the Lyon Trade and Companies Register under number 821 371 549, and any person making a purchase via the site. https://leshop-lyon.fr/

They aim to define the rights and obligations of the parties in the context of the online sale of second-hand musical instruments and equipment, as well as new accessories, offered by Le Shop Guitare Lyon to the consumer.

These general terms and conditions (GTC) apply to the exclusion of all other conditions and must be accepted by the customer before validating any order.

Article 2 – Products and prices

The products offered for sale by LE SHOP GUITARE LYON are mainly second-hand instruments, amplifiers, and effects, carefully selected, tested, and refurbished if necessary before being put on sale. Each product sheet includes a detailed description and photos that best reflect the actual condition of the item.

Despite our efforts, some details may escape the photos. Customers are invited to contact us for additional information or extra photos before finalizing their purchase.

Slight color variations may appear depending on the screens used.

Each second-hand item being unique, sales are made on a first-come, first-served basis.

Prices are indicated in euros, all taxes included (TTC), excluding delivery charges.
When required by law, the eco-participation (DEEE) is included and clearly indicated on the invoice.

Prices may be changed at any time, but products are billed based on the rate in effect at the time of the order.

In case of a manifest pricing error (inconsistent or abnormally low price), Le Shop reserves the right to cancel any order, even after confirmation.

Any change in the applicable VAT rate may be reflected in the final price.

Orders destined for outside the European Union may be subject to import duties and taxes, at the customer's expense. It is the customer's responsibility to check the electrical compatibility (voltage and type of plug) of the devices with their destination country and, if necessary, to use an appropriate transformer or adapter. The Shop cannot be held responsible for damages caused by incorrect power supply.

Article 3 – Order and payment

Orders can be placed on the site https://leshop-lyon.fr/  or directly in store.

When placing an order online, the customer agrees to provide accurate and complete information (contact details, delivery address, means of contact). Any error in this information releases LE SHOP GUITARE LYON from any liability in case of delay or inability to deliver.

Given that most of the products offered are unique second-hand items, their availability can only be guaranteed from the payment validation.
In case of unavailability of a product after the order is placed, the customer will be immediately informed and fully refunded.

The order is considered final after confirmation by automatic email and full payment processing.

The validation of the order implies full acceptance of these terms and conditions.

LE SHOP GUITARE LYON reserves the right to cancel any order in case of payment issues or suspicion of fraud.

Accepted payment methods:
– Credit card via Shopify Payments (secure payment)
– PayPal
– Payment in installments with Alma (subject to eligibility conditions)
– Check (orders in France, processing after clearance)
– Cash and credit card for in-store purchases

All online transactions are secure. Banking data is processed directly by payment providers and is never stored on our servers.

Article 4 – Delivery and pickup

Products are shipped within 1 to 3 business days after payment confirmation and processing (for checks). The available delivery methods are Colissimo, Chronopost, and UPS. Delivery charges, including packaging and transport insurance, are calculated and displayed at the time of order.

A free in-store pickup (Click & Collect) is available for all orders.

For heavy or bulky amplifiers, a specific quote may be necessary to ensure secure transport. For very high-value guitars, if no insured shipping solution covers the full value of the instrument, a hand delivery may be proposed.

Upon receipt of the package, the customer must check the condition of the packaging before signing the delivery note. In case of a damaged package, it is imperative to take photos of the package and its contents before opening and to make precise reservations with the carrier. Without these elements, it may be impossible to claim insurance.

Le Shop Guitare Lyon cannot be held responsible for delivery delays attributable to the carrier or in cases of force majeure.

Article 5 – Receipt and Returns

Upon receipt of the order, the customer must immediately check the condition of the package and the products. In case of an anomaly (damaged package, missing or damaged product), they must take photos before opening, make precise reservations on the delivery slip, and inform us within 48 hours by email at contact@leshop-lyon.fr Without these elements, no claim can be processed.

In accordance with article L221-18 of the Consumer Code, the customer has a period of 14 calendar days from receipt to exercise their right of withdrawal, without having to justify a reason or pay a penalty.

To exercise this right, the customer must contact us by email to obtain return authorization and shipping instructions. Products must be returned in their original condition, perfectly protected and in their complete packaging (accessories, manuals, etc.).

Return shipping costs are the responsibility of the customer, except in the case of an error on our part. Any damaged, incomplete product, or one whose condition does not allow for resale may be refused and returned to the customer at their expense.

Once the product is received and checked, the refund will be made via the initial payment method within a maximum period of 14 days.

Certain categories of products are not eligible for the right of withdrawal when they have been unsealed after delivery (strings, cables, software, maintenance products).

Article 6 – Warranties and After-Sales Service

All products sold by LE SHOP GUITARE LYON benefit from the legal warranty of conformity provided by articles L217-4 and following of the Consumer Code (2 years from the delivery of the goods) as well as the legal warranty against hidden defects provided by articles 1641 and following of the Civil Code.

In addition, all second-hand products sold by LE SHOP GUITARE LYON are covered by a commercial warranty of 3 months, including parts and labor.

For any request for warranty coverage or for after-sales service, the customer must contact us beforehand at the address contact@leshop-lyon.fr  to describe the problem and agree on the terms of return or repair. No return will be accepted without prior agreement.

When the failure is confirmed and covered by the warranty, the transport costs for return and reshipment are covered by THE GUITAR SHOP LYON.

The warranty does not cover:

  • normal wear and tear
  • damages resulting from improper use, lack of maintenance, unauthorized modification, or inadequate transport
  • defects reported to the customer before purchase and mentioned on the product sheet
    Repairs carried out outside the warranty are subject to prior estimate.

Article 7 – Personal data and cookies

The information collected during your orders and your browsing on the site is processed by THE GUITAR SHOP LYON in accordance with the General Data Protection Regulation (GDPR – No. 2016-679) and the Data Protection Act.

The personal data collected is used for:

  • the management of your orders and deliveries,
  • billing and payment tracking,
  • the sending of information and offers (if you have consented),
  • the respect of our legal and accounting obligations.

They are kept for the legal duration necessary for these purposes and are never sold to third parties. You have the right to access, rectify, delete, limit, and oppose the processing of your data, which you can exercise by email at contact@leshop-lyon.fr  or by mail to:

Article 8 – Liability and force majeure

 LE SHOP GUITARE LYON cannot be held liable for indirect damages resulting from the use of the site or the products sold, such as loss of data, loss of revenue, loss of opportunity, or any other immaterial damage.

LE SHOP GUITARE LYON's liability cannot be engaged in case of unavailability of the site, technical malfunction, or disruption of the Internet network, independent of its will.

LE SHOP GUITARE LYON cannot be held liable if the non-performance or delay in the performance of its obligations results from a force majeure event as defined in Article 1218 of the Civil Code. The following are considered force majeure events, without this list being exhaustive: strikes, pandemics, epidemics, natural disasters, fires, floods, power outages, transport blockages, wars, riots, or any other circumstance reasonably beyond the control of LE SHOP GUITARE LYON.

In the event of a force majeure occurrence, the performance of LE SHOP GUITARE LYON's obligations will be suspended for the duration of the event.

LE SHOP GUITARE LYON is not responsible for the content of third-party sites to which links present on the site may point.

The customer is responsible for the accuracy of the information provided during the order (name, address, phone, email). Any error or omission that may cause a delay or return of the package shall not engage the liability of LE SHOP GUITARE LYON. The costs related to a new shipment would then be borne by the customer.

Article 9 – Final provisions

Retention of title: The products remain the property of LE SHOP GUITARE LYON until full payment of the price by the customer.

Transfer of risks: The risks of loss or deterioration of the products are transferred to the customer as soon as the package is handed over to the carrier or upon collection in store.

Archiving and proof: Purchase orders and invoices are archived on a reliable and durable medium. They may be produced as proof in case of dispute.

Modification of the general terms and conditions: LE SHOP GUITARE LYON reserves the right to modify these general terms and conditions at any time. The applicable conditions are those in effect on the date of the order.

Partial nullity: If one of the clauses of these general terms and conditions is declared null or unenforceable, the other clauses shall remain fully in force.

Non-waiver: The fact that LE SHOP GUITARE LYON does not invoke a clause of these general terms and conditions cannot be interpreted as a waiver of its right to invoke it later.

Language of the contract: These general terms and conditions are written in French. In case of translation, only the French version shall prevail.

Applicable law and jurisdiction: These general terms and conditions are subject to French law. In case of dispute, and unless otherwise provided, exclusive jurisdiction is granted to the courts of Lyon.
